NHTSA defect petition over Robotaxi speeding in school zones

Sources (11)

Three developments stack up. (1) On 9 Oct NHTSA accepted defect petition DP26010, which alleges that the Robotaxi fleet speeds in school zones during school hours. It covers about 1,000 vehicles and is the first federal regulatory action aimed at real-world road performance since paid passenger service began.

(2) On a livestream, Musk gave the first official figure for the Optimus supply-chain bottleneck: China's export controls on rare-earth magnets have pushed the project back by 2-3 months. He again admitted that the 'hands' are the hardest part. (3) At the Paris Motor Show on 12 Oct, Tesla brought the steering-wheel-free Cybercab from its US Robotaxi fleet to Europe for its first public showing. A European version of the service is due in 2027 at the earliest, and it is tied to the EU's FSD decision in December.

Key evidence

  • NHTSA ODI defect petition DP26010, accepted on 9 Oct, alleges that Robotaxis modified from the Model Y, and the purpose-built Cybercab, speed in school zones during school hours. It covers about 1,000 vehicles in operation, and the petitioner attached 3 video clips as evidence (sources: NotaTeslaApp, TeslaNorth, Quartz and Business Insider, citing NHTSA ODI)
  • Regulatory attention has risen in step with the fleet's growth from 42 vehicles to 300+. For now the petition is only at the stage of deciding 'whether to open a case', not a formal investigation
  • Musk confirmed in livestreamed interviews on 10-11 Oct that China's export controls on rare-earth magnets have delayed Optimus by 2-3 months (the first time the supply-chain bottleneck has been quantified in an official statement)
  • Musk again acknowledged that the robot's 'hands' are the hardest part of the whole project (the hardware bottleneck, confirmed by Tesla itself for a second time)
  • The Information: by the end of September Tesla had accumulated more than 500,000 hours of Optimus training data, with an internal target of doubling it by year-end (a positive on the software side, and the data flywheel is turning)
  • Three bottlenecks have now been confirmed at once, officially or first-hand: supply (magnets), hardware (hands) and generalisation (AI). The risk that Optimus misses its 'on sale by the end of next year' target is building
Show 2 more
  • On the media day of the Paris Motor Show on 12 Oct, Tesla brought the Cybercab, with no steering wheel and no pedals, from its US Robotaxi fleet to Europe for its first public showing. It also offered visitors free rides in FSD (Supervised)
  • Cybercab service in Europe could launch in 2027 at the earliest, provided a number of regulatory and infrastructure hurdles are cleared

Catalysts to watch

  • 30 Oct: deadline for the sworn answer on Cybercab self-certification (NHTSA has already granted a 30-day extension)
  • Whether DP26010 is upgraded to a formal investigation (the key milestone)
  • EU-wide FSD decision in December (this sets the pace of any Cybercab launch in Europe)
  • Optimus training data doubling to the target of 1 million hours by year-end
  • Earliest European launch of Cybercab in 2027

Risks

  • If the school-zone speeding is substantiated, it strikes directly at Tesla's safety narrative of self-certified L4 operation with 'no human backstop needed'
  • Regulatory attention has risen in step as the Robotaxi fleet grew from 42 vehicles to 300+. Expanding scale means expanding regulatory risk
  • Three bottlenecks for Optimus (supply chain, hardware and generalisation) have been confirmed at once, so the risk of missing the 'on sale by the end of next year' target is building
  • Commercial Robotaxi service in Europe is still far from scale. Regulatory checkpoints across 27 countries set the pace, and 2027 is only the 'earliest' date
  • The Cybercab on show in Paris is a signal of intent, not delivery
